Terms and Conditions
Thank you for
supporting the
Each ticket has
a cost of $100 with one chance per ticket. A ticket represents a chance to win
the opportunity to accept an offer of the stated prize based on these terms and
conditions and those terms and conditions in the "Winner Notification
Agreement". If you hold a ticket, receipt or acknowledgement of receipt,
your ticket number has been entered in the raffle, subject to these terms and
conditions. Winning ticket numbers shall be selected by a drawing at random and
all participants have an equal opportunity to win. Payment of $100 constitutes
entry and assigned ticket. Tickets, receipts or acknowledgement of receipts not
received by the purchaser due to unforeseeable circumstances such as
non-deliverable mail, interrupted internet access, incorrect mailing address or
email address or any unintentional circumstances do not constitute refunds.
There are NO REFUNDS given for these reasons.
Tickets,
receipts and winners' rights are not transferable. More than one person may
share in the raffle ticket purchase however, title to the property shall be
given to the name as appears on the entry form and are not transferable or
assignable. It is the sole responsibility of the winner in a multiple party
entry to allocate any prize among the participants in the multiple party entry. Winners need not be present at the drawing.
Winners agree
to accept all prizes in their "AS IS, WHERE IS" condition, subject to
all latent and patent conditions, with absolutely no express or implied
warranties of any kind by the Swift Museum Foundation.
Each winner
will be notified in writing in a Winner Notification Agreement, which will be
sent by certified, return receipt U.S. Mail to the address provided by that
winner. Each winner will have fifteen (15) days from the date of his/her
receipt of the Winner Notification Agreement to accept the prize by executing
and returning the Winner Notification Agreement pursuant to the terms stated
therein. Failure to execute and return the Winner Notification Agreement and
accept the prize "as is" timely and pursuant to the terms stated in
the Winner Notification Agreement, will automatically result in forfeiture of
the prize, with no substitution or alternative prize available to the original
winner. In the event of forfeiture, the next winner that was selected will be
awarded the prize.
Prize(s) not
claimed within fifteen (15) days of the drawing become the property of the
Swift Museum Foundation.
Prize(s) will
not be awarded and will be deemed forfeited, if the winner's ticket was issued
in exchange for a check returned for "insufficient fund" of a credit
card charge deemed "declined", "invalid", or
"stolen".
Purchaser of
tickets and Winners must be 18 years of age at the time the ticket is
purchased.
All sales of
tickets are final and there shall be no refunds.
The Swift
Museum Foundation reserve the right to cancel the raffle and provide refunds
for any tickets sold.
Tennessee State
Law requires the Swift Museum Foundation to generate a 25% net profit to
fulfill their obligation. The Swift Museum Foundation reserves the right to
refund all ticket purchases in such case that a 25% profit will not be
realized.
The grand prize
winner will have the choice of the Swift or a cash option, amount to be
determined at the end of ticket sales. The grand prize winner(s) will have
fifteen (15) days from the raffle drawing date to elect in writing to accept
either the Swift or the cash option. If the grand prize winner chooses the Swift
option, the winner is responsible for any applicable taxes, fees, insurance
premiums, and all
costs of transporting the Swift to the winner’s airport.
The Swift
Museum Foundation does not rent or sell its donor or supporter list information
to third parties.
Winners shall
have no rights in prizes until the prize is fully and unconditionally accepted
by the winner.
Winners will
not use prize for any further fundraising event.
Employees and
board members of the Swift Museum Foundation and their spouse and legal
dependants are prohibited from purchasing tickets and are not eligible to win
any prize. This includes individuals for whom an employee or board member is
the current legal guardian or individuals who are not legally related to but
who reside with an employee or board member ("step" relationships are
also included).
The winner
accepting the Swift will be subject to all applicable laws and regulations.
The Swift
Museum Foundation will make all decisions and interpretations of rules and
regulations and their judgment is final. An independent accounting firm will
audit the event.

prohibited by law.
